A neutral comparison of hiring in Italy as a contractor, through an Employer of Record, or with your own entity, on speed, risk and cost.
Contractor, EOR or entity: how to start in Italy

You want to hire someone in Italy. You have not decided how. There are three common routes: engage a contractor, use an Employer of Record (EOR), or set up your own Italian entity. Each fits a different situation. This article compares them on speed, risk and cost, without a favourite.

Contractor

A contractor is self-employed. They invoice you for a service. You do not put them on payroll.

Speed. This is the fastest route on paper. You sign a services agreement and start. There is no entity to register and no payroll to run.

Risk. This is where contractors get complicated. Italian authorities and courts look at how the work is really done, not at what the contract says. If the person works set hours, follows your instructions, uses your tools and works only for you, the arrangement can be treated as employment. The consequences can include back contributions, penalties and claims from the worker. The risk grows the longer the relationship lasts and the more the person is embedded in your team.

Cost. The visible cost is low. You pay the invoice and nothing else. The hidden cost is the exposure if the relationship is reclassified. Contractors also tend to expect a higher rate, because they carry their own taxes, contributions and downtime.

Best for. Short projects, specialists with several clients, and work you do not need to direct day to day.

Employer of Record

An EOR becomes the legal employer in Italy. You choose the person and direct the work. The EOR issues the employment contract, runs payroll, pays contributions and handles the administration that comes with having an employee.

Speed. Usually fast, because the EOR already has an Italian setup. You do not wait for incorporation. The time it takes depends mostly on how quickly you agree the role and terms with the candidate, and on any work authorisation needed if the person is not already entitled to work in Italy.

Risk. Lower than with a contractor, because the worker is a real employee under the correct national collective agreement. You still carry business risk. You decide who to hire, how they perform and when the role ends, and dismissal in Italy follows its own rules. A good EOR helps you manage that, but it cannot remove it. You also depend on the provider, so check how they handle payroll errors, data and exit.

Cost. You pay the employee’s full employment cost plus the EOR’s fee. There are no incorporation or accounting costs of your own. For a small team, this is often cheaper than running an entity. As headcount grows, the fee adds up and the comparison can change.

Best for. Testing the market, hiring a few people, or hiring where you need compliance without building local infrastructure.

Own Italian entity

You register a company in Italy and employ people directly.

Speed. The slowest route to the first hire. You must incorporate, open a bank account, register with the tax and social security bodies, set up payroll and find an accountant and a labour consultant. Each step has its own waiting time.

Risk. You become fully responsible for compliance. That includes payroll, contributions, health and safety, employment contracts, reporting and corporate filings. The legal protection of a local company is real, and so is the burden. Mistakes are yours.

Cost. Highest at the start, because of setup and ongoing professional fees. It becomes more efficient when you have enough people and enough long-term commitment to spread those fixed costs. You also gain full control over contracts, benefits and how the business is presented locally.

Best for. Companies with a long-term plan in Italy, a team that will grow, or customers and partners who expect a local company.

How to choose

Ask these questions.

  • Will the person work like an employee? If you set their hours and direct their tasks, a contractor is the wrong tool. Use an EOR or an entity.
  • How sure are you about Italy? If you are still testing, avoid fixed costs. A contractor or an EOR keeps you flexible.
  • How many people will you hire? A few people suit an EOR. A larger team usually justifies an entity.
  • How fast do you need to start? Contractor and EOR are quicker. An entity takes planning.
  • Who do you want to carry the admin? With an EOR, the provider does. With an entity, you do.

Many companies move through these routes in order. They start with a contractor for a defined project, move to an EOR when the person becomes a core team member, and open an entity once the Italian operation is large enough to stand on its own. The move from EOR to entity is common and can be planned, so starting with an EOR does not lock you in.

No route is the best in general. The right one depends on the role, the time horizon and how much risk and admin you want to hold yourself.
