Keep Your EOR for New Markets After You Set Up in Italy

You hired your first people in Italy through an Employer of Record (EOR). The team grew. Now you are thinking about your own Italian entity. That is a sound step. It does not mean you should drop the EOR.

Many companies end up with a hybrid model. They run their own entity where they have scale. They keep an EOR where they do not. This article explains how that works and when it makes sense.

Why companies set up their own entity

An entity gives you direct control. You hold the employment contracts. You run payroll or choose your own provider. You build a local brand as an employer. For a stable team with a clear future in Italy, this is often the right call.

It also brings fixed work. You need local accounting, payroll, tax filings, a registered address and someone who is accountable for compliance. That work has a cost whether you hire one person or many.

That is why the decision depends on volume and certainty. Where you have both, an entity pays off. Where you have neither, it does not.

Why the EOR still matters

Your Italian entity solves Italy. It does not solve the next country.

When you test a new market, you usually do not know how it will go. You may hire one person to open sales. You may need a small engineering group for a short project. You may not yet know if the market will stay. Setting up a company in every country for that kind of uncertainty is slow and heavy.

An EOR lets you hire in that market right away. The EOR is the legal employer. You direct the daily work. You skip the entity setup, and you can scale up, scale down or move on without closing a company.

How the hybrid model works

The idea is simple. Match the structure to the maturity of each market.

  • Mature market: your own entity. Italy fits here once the team is stable.
  • New market: an EOR. You hire fast and learn before you commit.
  • Growing market: start on an EOR. When the team and revenue justify it, move to an entity.

Each country is judged on its own. You do not need one rule for the whole company.

What this gives you

Speed. A new hire in a new country can start without waiting for incorporation, bank accounts and registrations.

Lower risk. If a market does not work out, you end the arrangement. You are not left with a dormant company to wind down.

Focus. Your internal team spends its time on the markets where it has depth. It does not need to learn employment rules in every country at once.

A clear path. You can move from EOR to entity later. Plan for it from the start so the switch is orderly.

Where the model needs care

A hybrid setup is not automatic. A few points need attention.

Keep one view of your people. With some staff on your entity and some on EOR providers, data can scatter. Decide early where headcount, cost and contract records live. A simple shared sheet is better than none.

Be consistent on terms. Employees in different countries will compare notes. You do not need identical packages. You do need a logic you can explain.

Watch for permanent establishment questions. If staff in a country start acting like a local branch of your company, tax authorities may take notice. This is a real topic for team size and role type. Take local advice before a team grows beyond a pilot.

Plan the transfer. When you move a market from EOR to entity, employees change employer. This needs clear communication, correct paperwork and respect for the rights each person has built up. Start early and tell people why.

Choosing your provider

If you use an EOR in several countries, you have two broad options. One is a single global provider. The other is a local specialist in each market. A single provider gives you one contract and one invoice. A local specialist usually knows the national rules, collective agreements and practice in more depth.

For Italy, depth matters. Collective agreements, contribution rules and visa steps vary by sector and by role. A provider who works in Italy every day will see problems before they reach you. The same logic applies in other countries.

A practical way to decide

For each market, ask these questions:

  • Do we know the team will be there for the long term?
  • Is the headcount large enough to carry the fixed cost of an entity?
  • Do we need to hold the employer relationship ourselves?
  • Can we support local compliance in house or through advisers?

If most answers are yes, plan the entity. If most are no or not yet, stay on an EOR and review later.

The short version

Setting up in Italy is a milestone, not a finish line. Keep your own entity where you are settled. Keep an EOR where you are still learning. Review each market as it grows.
